Frequently Asked Questions

  • I’m not sure if my case is a family law case. What cases are considered family law?
Family law deals with family-related issues and domestic relations. These include divorce and the issues related to divorce such as the division of marital property, child custody and support, and alimony. At Tillson & Shaw we assist clients in these areas in addition to drafting prenuptial and postnuptial agreements and litigating related matters. Juvenile delinquency, and child abuse and neglect are also areas of family law that Tillson & Shaw can assist you with. This is not an exhaustive list. If you are still unsure about your legal needs please reach out to our staff for assistance.
  • I’m going through a divorce, and I think I can do it on my own without an attorney. Is there anything I should consider before going down that route?
The decision to divorce your spouse is difficult. Many difficult decisions have to be made before a divorce can be finalized. This includes how to divide the property and debts, whether alimony will be awarded, and, if children are involved, how to handle custody, visitation, and child support. Ideally, you and your spouse will be able to agree on some or all of these things. If you cannot agree, the judge will have to make the decisions for you. Tillson & Shaw provides a professional, and experienced staff that can help with all of your needs so that your future is as secure as it can be when you move into the next phase of your life.
  • Can I change my child custody order?
Once a custody order has been approved by the court changing it can be a challenge. Either parent can ask the court to change the custody or visitation order if it is not working. A basic tenants of Maryland law is that any court decisions on custody and visitation must be based on the best interest of the child.
